Consent Agenda

“The Consent Agenda is a group of routine matters to be acted on with a single motion and vote.” The Town Council unanimously approved all 5 items (details in the packet).

“Amended and Restated Operations Maintenance Intergovernmental Agreement for Johnstown Plaza, Johnstown, Colorado and District/Developer Operations and Management Agreement for Johnstown Plaza, Johnstown, Colorado.” Attorney O’Leary with Spencer Fane LLP addressed an amendment to codify public improvements, including the operation and maintenance of the Johnstown Plaza, and to manage the metro district for the owners of the Plaza.

The council unanimously approved the amended agreement.

“Amended and Restated Operations and Maintenance Intergovernmental Agreement for Ledge Rock Center Commercial, Johnstown, Colorado and District/Developer Operations and Maintenance Agreement for Ledge Rock Center Commercial, Johnstown, Colorado.”

Attorney McGeady with McGeady Becher P.C. requested approval for an amended agreement with the developer to collect monies from the tenants through their leases, using a mill levy from the original Metro District agreement, and in turn, the developer will provide the necessary infrastructure services.

The council unanimously approved the amended agreement.

“Consider approval of the Xcel Energy off-site distribution line extension agreements between Johnstown, Co. and Xcel Energy for the water treatment plant extension.” The modification is needed for insurance purposes and will cost the town an additional $571,434. The council unanimously approved.

“Consider a request from Johnstown YMCA to construct a shade structure adjacent to existing ball fields on the town recreation center property.” Johnstown Planner Tyler Smith wrote the proposal. This will be a steel structure with a decorative brick base for each post, open on all 4 sides, with picnic tables for public use. The council unanimously approved.

A change order to Town Alleyway Aesthetics Improvements was requested for BHA Design Inc. This will cost the town approximately $63,750 in additional design for underground utilities, trash containers and parking. Some of the small businesses in the area will lose private parking areas and trash receptacles. BHA has agreed to respect owners’ decisions and minimize impact. The council unanimously approved the change order.

A contract award of $435,691 is requested for Lightfield Enterprises, Inc. to complete the 2024 Johnstown Concrete Repair Program. This amount is already included in the 2024 budget with an additional 5% contingency for unexpected expenses. The council unanimously approved the contract with Lightfield Enterprises, Inc.

The council unanimously approved 2 ordinances for the Front Range Fire Rescue Fire Protection District Annexation. Two small pieces of property, 0.098 acres each, part of the original fire protection district annexation, were temporarily exchanged for access. The project is finished, and the Front Range Fire Rescue is ready to bring these pieces back into the current annexation.

Mayor Mellon praised the opening of Colorado’s first Buc-ee’s convenience store/gas station. Mellon said, “There was a lot of traffic and a lot of money spent. This is a good day for Johnstown.”

Are the commercial tenants of Ledge Rock Commercial Center aware of the additional mill levy included with their leases? When will the tenants start paying the additional amounts?
